Your landlord's repair duties in Dial Post
Under Section 11 of the Landlord and Tenant Act 1985, every landlord in Dial Post must keep the structure and exterior of your home in repair, along with the installations for water, gas, electricity, sanitation, heating and hot water. The Homes (Fitness for Human Habitation) Act 2018 goes further: your home must be fit to live in from the day your tenancy starts and for as long as it lasts. These duties apply to council homes, housing association properties and private rentals in Dial Post alike.

How a housing disrepair claim works in Dial Post
We have kept the process as straightforward as possible for tenants in Dial Post:
- Free claim check. Call us or fill in the short form. We ask about the problems, how long they have been going on and what your landlord has done about them.
- Evidence and inspection. An independent expert visits your home, records every defect and sets out exactly what your landlord needs to do to fix it.
- Letter of claim. A formal letter puts the landlord on notice. Most landlords, including councils and housing associations, settle at this stage rather than go to court.
- Repairs and compensation. You get the repairs done, you get paid, and because the claim is no win, no fee, our costs are recovered from the landlord.
Compensation for tenants in Dial Post
Most awards are based on the rent paid during the period of disrepair. Mild problems in one room might attract around 20% of rent; a home made largely uninhabitable by damp, mould or no heating can attract 50% or more. Damaged furniture, clothing and carpets, and any health effects, are added on top.
For example, a tenant in Dial Post paying £450 a month (£5,400 a year) whose claim is valued at 20% would receive around £1,080 for each year of disrepair, or about £1,080 over 1 year, before adding anything for damaged belongings or ill health. Claims can go back up to six years.

Housing disrepair in Dial Post: frequently asked questions
Can I claim if I have already moved out?
Yes, as long as the disrepair happened within the last six years and you reported it to your landlord at the time. You can claim compensation for the period you lived with the problems even though repairs are no longer needed for you.
Do I have to pay anything?
No. We work on a no win, no fee basis. There is nothing to pay up front, and if the claim is unsuccessful you pay nothing. If the claim succeeds, legal costs are recovered from your landlord and an agreed success fee is deducted from your compensation, which we explain clearly before you sign anything.
What if my landlord in Dial Post says the damp is my fault?
"Lifestyle" or "condensation" is a common response from landlords, but it is often wrong. Damp caused by leaking pipes, defective roofs, failed damp-proof courses or inadequate ventilation and heating is the landlord's responsibility. A surveyor can identify the real cause, and the Homes (Fitness for Human Habitation) Act makes landlords responsible for homes that are unfit because of damp and mould.
How long does a housing disrepair claim in Dial Post take?
Many claims settle within six to nine months of the letter of claim. Urgent repairs can often be forced through much sooner, and if your landlord accepts liability early the whole process can be quicker. Cases that go to court take longer, but that is rare.
Will I be evicted for making a claim in Dial Post?
Secure and assured tenants of councils and housing associations cannot be evicted for making a disrepair claim. Private tenants in England are protected from "retaliatory eviction" where the council has served an improvement notice, and the Renters' Rights reforms have strengthened protection further. We will explain your position before you decide to go ahead.
